A. PROCEDURE FOR REPORTING INTELLECTUAL PROPERTY INFRINGEMENT

At Lumecraft.shop, we take intellectual property rights seriously. It is our policy to:

  1. Block access to or remove any content (including, without limitation, text, graphics, and photos) (collectively, “Content”) that we believe in good faith infringes the intellectual property rights of third parties upon receiving a valid notice; and
  2. Remove and discontinue service to repeat infringers.

If you believe that Content on or accessible through Lumecraft.shop infringes your copyright or other intellectual property rights, please send a notice of infringement to our Designated Agent with the following details:

  1. Identification of the copyrighted work or intellectual property you claim has been infringed, including registration number(s) if applicable;
  2. Identification of the Content you claim infringes your rights, including:
    • (a) A description of how the material is using your copyrighted work or intellectual property in a way that constitutes infringement;

B. ONCE PROPER BONA FIDE INFRINGEMENT NOTIFICATION IS RECEIVED BY THE DESIGNATED AGENT

Upon receiving a valid infringement notice, it is our policy at Lumecraft.shop to remove or disable access to the allegedly infringing Content.


C. PROCEDURE TO SUPPLY A COUNTER-NOTICE TO THE DESIGNATED AGENT

If we believe the removed or disabled Content is not infringing, or if we have the right to use it (e.g., through permission from the rights owner, their agent, or under fair use laws), we will send a counter-notice to the Designated Agent with the following:

  1. Identification of the Content that was removed or disabled, including where it appeared on Lumecraft.shop before removal;
  2. A statement, under penalty of perjury, that we have a good faith belief the Content was removed or blocked due to a mistake or misidentification;
  3. Our contact information, including full name, mailing address, phone number, and email address;
  4. A statement that we consent to the jurisdiction of the Federal Court for the judicial district where our address is located;
  5. Our electronic or physical signature.

If the Designated Agent receives a counter-notice, we may forward it to the original complainant, informing them that we may restore the removed Content or cease disabling it within 10 business days. Unless the rights owner files a court order against us, the Content may be restored or access reinstated between 10 to 14 business days (or more) after receiving the counter-notice, at our discretion.


IMPORTANT NOTE

Under Section 512(f) of the DMCA, anyone who knowingly misrepresents that Content or activity is infringing may be liable for damages, including attorney’s fees.
